Nature of the contract

Under this contract Gourmetissimus, S.L. with central administration and general office in Hedilla c, 4-10, and NIF B-65975583, registered at the Mercantile Registry of Barcelona, volume 43706, folio 179, page B436081, Inscription 1, (hereinafter “Gourmet Hunters”) sales to the customer (any natural or legal person who underwrites any purchasing contract from its catalogue) and the customer purchases to Gourmet Hunters the product specified in the commercial invoice. For the purpose of this trade the term “Contract” refers to the transaction that puts into effect this document. The term “Product” refers to the goods subject of the Contract. 

All the Product Purchase Orders accepted by Gourmet Hunters are so in agreement with the following General Service Terms and Conditions, which will be a part of the contract of sale. Acceptance of the products entails the acceptance of these General Service Terms and Conditions.

It is not necessary to be registered in the website to place an order or booking in Gourmet Hunters.

Price Policy and Availability

Gourmet Hunters reserves the right to modify the Price of the products and services offered through their website at any moment and unilaterally. In order to guarantee to the customer the certainty and truthfulness of the Price at the moment of placing the order, the prevailing Price would be the one shown on the publicity at that moment.

The final price or retail price of the product sold is clearly presented as the customer final cost including VAT (if applicable), shipping costs, insurance charges and delivery fees. Final cost, hence, will be notified to customer during the electronic purchasing process before the acceptance is formalized by clicking on “acceptance of the order”.

Possible discounts and or promotional gifts will be voluntarily directed by Gourmet Hunters to designated groups at any moment or according to the offered product, in relationship with the existing advertisement in the website.

No responsibility or liability is assumed by Gourmet Hunters for any typographical, technical, arithmetic or other inaccuracies which may appear in the website

Information on the offered product to customer includes all the technical features, description, manufacture’s trademark and guidance photography.

Gourmet Hunters does not guarantee the complete availability of all the products in the catalogue at the time of purchase. In the event that the product is out of stock or there is a vintage change, Gourmet Hunters will contact customer at the earliest opportunity to inform about the delay or changes and reach an agreement.

Acceptance of the order

At the moment of formalizing an order, once the “Acceptance of the order” has been clicked, it is understood that customer has agreed on the validity and effectiveness of the sale contract which binds both parties. Gourmet Hunters will store electronically the order, typing errors excepted, in which case the order will not be processed. 

After the acceptance of the order, Gourmet Hunters will inform customer sending an order confirmation together with the General Service Terms and Conditions to the e-mail indicated by the customer.

The sale and delivery commitment from Gourmet Hunters is subject to the advertised product stock and its availability until the end of stock, therefore Gourmet Hunters, following its commitment of quality and service to customer, will strive to have all the advertised products in stock at all times. Nevertheless, under exceptional circumstances as abusive order, multiple interactive order or any other that might lead to stock rupture, the order and the concluded contract between the parts shall cease to have effect by virtue of the present cancellation clause, restoring entirely the eventually prepaid quantities to customer.

 Payment

Payment of the product will be made by any of the payment methods stated as follows: bank transfer, VISA, MASTERCARD, MAESTRO, AMEX credit card or by platform PAYPAL. Other local payment methods, depending on the country where the order is placed, such as, iDEAL, Sofort, GiroPay, TrustPay, Paysafecard  and some more, can be used.

Gourmet Hunters will immediately deliver the corresponding invoice by e-mail after the order shipment confirmation.

On credit card payments, when customer presses the “ACCEPT” button during the order confirmation, the bank will verify the card validity and checks it is not blocked. The card will be charged at the time of purchase.

In any case has Gourmet Hunters any Access to the customer’s bank data neither are the data stored in their servers. For this reason, customer will have to provide the bank details at every new transaction in our website. Thus there is double protection against fraud and abuse.   

All purchase transactions are developed within a strict confidentiality framework and encrypted thanks to the SSL protocol. Thereby, Gourmet Hunters guarantees to customer the complete confidentiality of the data furnished by customer by means of encryption, avoiding its possible communication to any third parties outside the legal relationship, pursuant to current Law 15/99 of Personal Data Protection. Randomly, to intensify the security and to verify the reliability of the data provided at the moment of placing the order, the company may request to the customer additional data (such as D.N.I. copy or proof of address at least three months old) that allow verifying the purchase has been done by the card holder. The document should be sent within the five following working days. Gourmet Hunters reserves the right to reimburse the order if the requested documentation is not received or in the case they are not valid.  

Equally, Gourmet Hunters reserves the right to cancel or refuse any order from a customer with whom there are litigations on a previous order.

This merchant agrees not to allow any transaction that is unlawful, or is deemed by credit card brands or the acquiring bank to be, or to have the potential to damage or negatively influence the goodwill of any such transaction. The following activities are prohibited under the card brand programs: the sale or offering of a product or service that is not in full compliance with all applicable laws to the Buyer, Issuing Bank, Merchant, Cardholder, or Cards. In addition, the following activities are also explicitly prohibited:'Sale of alcoholic beverages to persons under the age of 18'.

Shipments

Shipping charges may vary depending on the total weight of the goods purchased. Customer will be able to know exactly the total amount of the shipment charges from the website before accepting and confirming the order.

Orders, shipping to Mainland Spain and Balearic Islands, are usually delivered within a period of 24/48 working hours from the time they have been dispatched from our warehouse. 

Orders shipped to EU countries are delivered within an estimated 3-5 working day period from the time they have been dispatched from our warehouse. Scheduled time may suffer significant variations depending on the shipping service selected and the destination country. 

All orders received until 2:00 pm on weekdays are generally dispatched next working day for all products in stock. Shipping orders should not be processed, paid by bank transfer, until confirmation of payment and they are excluded of being dispatched next working day as direct payment shipping orders system works. Orders received on Friday, Saturday and Sunday will not be dispatched until next working day. 

Should there be any exceptional problem in transport due to reasons beyond Gourmet Hunters control; the customer would be immediately informed.

Deliveries

The order will be delivered at the address given at the implementation of the order. It will be possible to revise the delivery address will be possible only before the order has been picked up by the express courier service. Once the order has been picked up by the carrier the change of delivery address will only be possible at customer’s expense and subject to the parts agreement. Goods would be delivered to customer by a transportation and logistics company, together with a waybill stating full order details so customer, order number and number of packages can be identified.

All orders have an extensive insurance that covers breakage, loss and shipping and handling risks caused by a sudden and unforeseeable event

Important: Please make sure the package received is externally in good conditions. If not, make a note in the transport waybill, refuse the delivery and report in written to our Customer Service Department within the next 24 hours. Carrier companies do not allow the return of the goods in case customer opens the package in their presence.

Cancellations and Returns

Orders can be cancelled free of charge until the moment the goods are shipped. Should we receive a Notice of Cancellation once the goods are shipped, it would be considered a Return. The customer has maximum 14 calendar days to return his order from the delivery date when it was received to return day when it reaches our warehouse. The customer should pay the return shipping costs.

Should there be evidence of mishandling, opening or inappropriate storing conditions of the products, customer will lose the right of return. We will only accept goods returned in their original packaging, duly protected and in perfect conditions to be sold again.

No package missing any of the sender’s identifying elements (complete name, address and purchase order number) will be accepted.

Nevertheless, if your order is flawed because of a mistake on our part, we'll replace it as quickly as possible at no additional cost to you. Gourmet Hunters should replace the defective product for another equal or make a money refund with the exception of old wines acquired in auctions. Gourmet Hunters will pay any return and shipping charges. In the event the Exchange is not possible, the invoice amount will be returned as well as the proportional shipping expenses.
